Welcome to GuestPostKit. These Terms of Service (“Terms”) govern your access to and use of the website guestpostkit.com (the “Site”) and the GuestPostKit WordPress plugin (the “Plugin”), both provided by Bongi Technologies LLC, a limited liability company registered in the State of Delaware, United States (“we”, “us”, “our”).

By purchasing, downloading, installing, or using the Plugin or Site, you (“you”, “Customer”) agree to be bound by these Terms. If you do not agree, do not use the Plugin or Site.

1. Eligibility

To purchase or use the Plugin, you must be at least 18 years old and capable of entering into a binding contract under the laws of your jurisdiction. By using the Plugin, you represent that you meet these requirements.

2. License & Site Limits

2.1 Plugin Code License

The GuestPostKit plugin code is licensed under the GNU General Public License v2 (GPLv2) or later, in accordance with WordPress requirements. A copy of the GPL is available at https://www.gnu.org/licenses/gpl-2.0.html.

This means you are free to use, modify, and distribute the plugin code under the terms of the GPL.

2.2 What Your Purchase Buys

Your paid license grants you access to:

  • The Plugin download
  • Automatic updates during the active license period
  • Customer support at the level included in your plan
  • A license key for activating updates on your purchased number of sites

Updates, support, and the license key are services we provide on a commercial basis. Your right to receive these services is governed by these Terms, not by the GPL.

2.3 Site Limits — Strictly Enforced

Each license plan permits use on a specific maximum number of WordPress installations:

  • Starter — 1 site
  • Pro — 5 sites
  • Business — 25 sites
  • Agency Unlimited — Unlimited sites

Site limits are enforced strictly. A “site” is any unique WordPress installation on which the Plugin is activated, including staging, development, and subdomain installations. There are no exceptions.

If you exceed your site limit, additional activations will be blocked. To use the Plugin on more sites, upgrade to a higher plan or purchase an additional license.

2.4 Prohibited Uses of the License

You may not:

  • Share, resell, sublicense, or transfer your license key to third parties.
  • Use a single license across more sites than your plan permits.
  • Resell the Plugin under your own brand, except as expressly permitted under the white-label provisions of the Agency Unlimited plan.
  • Use the Plugin in a way that violates applicable law.

Violation of these restrictions may result in immediate termination of your license and access to updates and support, without refund.

3. Orders, Pricing & Payment

3.1 Pricing

All prices are listed in US Dollars (USD) and exclude any applicable taxes, which are added at checkout where required.

3.2 Annual Subscriptions

GuestPostKit is sold on an annual subscription basis. Your subscription renews automatically each year at the then-current renewal price unless you cancel before the renewal date.

We send a renewal reminder email 14 days before your subscription renews. You can cancel at any time from your account dashboard or by emailing [email protected].

3.3 Payment

Payments are processed through Stripe and PayPal. By placing an order, you authorize us to charge your selected payment method for the initial purchase and any subsequent renewals until you cancel.

3.4 Refunds

Refunds are governed by our Refund and Returns Policy, which forms part of these Terms.

4. Updates, Support & License Lapse

4.1 During Active License

While your license is active, you receive:

  • Automatic plugin updates (bug fixes, security patches, new features)
  • Support per your plan tier (community, email, or priority)

4.2 After License Expiry or Cancellation

If your license expires, is cancelled, or is refunded:

  • Automatic updates stop.
  • Support access ends.
  • The Plugin will continue to function on your sites under its existing version, in accordance with the GPL.
  • You will not receive security patches, bug fixes, or new features unless you renew.

We strongly recommend keeping an active license for security and compatibility reasons.

5. Acceptable Use

You agree not to use the Site or Plugin to:

  • Violate any applicable law or regulation.
  • Send spam, malware, or harmful content.
  • Engage in deceptive SEO practices, link schemes, or content that violates search engine guidelines on sites where you have installed the Plugin in a way that exposes us to legal or reputational risk.
  • Reverse-engineer or attempt to extract our license-validation server logic.
  • Resell, sublicense, or redistribute the Plugin in violation of Section 2.

6. Customer Responsibilities

You are solely responsible for:

  • The WordPress installation, hosting, theme, and other plugins on which GuestPostKit runs.
  • The content posted by guest contributors using the Plugin on your sites.
  • Compliance with all laws applicable to your business — including privacy laws (GDPR, CCPA), consumer protection laws, tax laws, and content/SEO regulations.
  • Backups of your WordPress site, database, and data.
  • Maintaining the security of your license key and account credentials.

We are not responsible for any data loss, downtime, or third-party content issues on your sites.

7. Affiliate Program

If you participate in the GuestPostKit Affiliate Program, additional terms apply:

  • Commissions are paid as a percentage of net sales attributed to your unique referral link, after refunds and chargebacks.
  • A 30-day cookie attribution window applies.
  • Self-referrals, fraudulent referrals, and referrals generated through misleading, spammy, or trademark-infringing tactics (including paid search ads on our brand terms) are not eligible for commission.
  • Minimum payout thresholds and payment schedules are published on the affiliate page.
  • We reserve the right to suspend or terminate any affiliate account that violates these Terms.

8. Intellectual Property

8.1 Plugin Code

The Plugin code is GPL-licensed as described in Section 2.1.

8.2 Trademarks & Brand

The names “GuestPostKit” and “Bongi Technologies”, our logos, the design and content of the Site, marketing copy, documentation, screenshots, and graphic assets are owned by Bongi Technologies LLC and protected by trademark and copyright law. You may not use them without our prior written permission, except for fair use in reviews or affiliate promotion as expressly permitted.

8.3 Feedback

If you send us suggestions, ideas, or feedback about the Plugin, you grant us a worldwide, royalty-free, perpetual license to use that feedback to improve our products without obligation to you.

9. Third-Party Services

The Plugin integrates with third-party services such as Stripe, PayPal, Google reCAPTCHA, and Copyscape. Your use of those services is governed by their own terms. We are not responsible for the availability, accuracy, pricing, or actions of any third-party service.

10. Disclaimers

THE PLUGIN AND SITE ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.

We do not warrant that:

  • The Plugin will be uninterrupted, error-free, or compatible with every theme, plugin, or hosting environment.
  • The Plugin will produce any specific SEO, traffic, revenue, or content outcome.
  • The Plugin will be free of vulnerabilities or that all bugs will be fixed.

You use the Plugin at your own risk.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BONGI TECHNOLOGIES LLC, ITS OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, BUSINESS INTERRUPTION, OR LOSS OF GOODWILL — ARISING OUT OF OR RELATED TO YOUR USE OF THE PLUGIN OR SITE, EVEN IF ADVISED OF THE POSSIBILITY.

Our total aggregate liability for any claim arising out of or relating to these Terms or the Plugin shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless Bongi Technologies LLC and its officers, employees, and affiliates from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising out of:

  • Your use or misuse of the Plugin or Site
  • Your violation of these Terms
  • Your violation of any law or third-party right
  • Content submitted, published, or managed using the Plugin on your sites

13. Termination

We may suspend or terminate your license, account, or access to the Site at any time, with or without notice, if you breach these Terms, engage in fraudulent activity, or initiate a chargeback without first contacting us. Upon termination:

  • Your license key will be deactivated.
  • Updates and support will stop.
  • Any outstanding refund eligibility under our Refund Policy will be reviewed.

You may stop using the Plugin and cancel your subscription at any time per Section 3.2.

14. Governing Law & Disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles.

Any dispute arising out of or relating to these Terms or your use of the Plugin or Site shall be brought exclusively in the state or federal courts located in Delaware, USA, and you consent to the personal jurisdiction of those courts.

The United Nations Convention on Contracts for the International Sale of Goods does not apply.

15. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date at the top and, where appropriate, notify you by email or via a notice on the Site. Continued use of the Plugin or Site after changes means you accept the revised Terms.

16. Miscellaneous

  • Entire agreement. These Terms, together with the Privacy Policy and Refund and Returns Policy, constitute the entire agreement between you and us.
  • Severability. If any provision is found unenforceable, the remaining provisions remain in full force.
  • No waiver. Our failure to enforce any provision is not a waiver of that provision.
  • Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of assets.
  • Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
